UNITED STATES DISTRICT COURT FOR THE DISTRICT OF NEW JERSEY
Fittipaldi v. Monmouth University, Case No. 3:20-cv-05526-RLS
IF YOU ARE A PERSON WHO PAID MONMOUTH SPRING 2020 SEMESTER TUITION AND FEES OR WHO BENEFITTED FROM THE PAYMENT, AND WHOSE TUITION AND FEES HAVE NOT BEEN REFUNDED, YOU MAY BE ENTITLED TO A PAYMENT FROM A CLASS ACTION SETTLEMENT.
- A Settlement has been reached in a class action lawsuit against Monmouth University (“Monmouth” or “Defendant”). The class action lawsuit involves whether Monmouth breached an implied contract with its students to provide physically in-person, on-campus educational services for the Spring 2020 Semester by transitioning to remote learning and services in March 2020 in response to COVID-19 without issuing partial tuition and fee refunds. Monmouth denies all allegations of wrongdoing and liability. There has been no finding of liability by any Court. However, in order to support its students and to resolve the matter, but without admitting any wrongdoing, Monmouth has agreed to establish a Settlement Fund to resolve all claims in this case (the “Settlement”).
- You are included if you are a person who paid Defendant Spring 2020 Semester tuition and fees or who benefitted from the payment, and whose tuition and fees have not been refunded. Those included in the Settlement will be eligible to receive a pro rata (meaning equal) portion of the Settlement Fund, not to exceed $155.00 (less any outstanding balance from the 2019-2020 academic year still owed to Defendant), which will be based on the total out-of-pocket amount of tuition and fees paid for the Spring 2020 Semester.
Your legal rights are affected even if you do nothing.
